Asbestos Breaches Result in Fine

Failing to control the spread of asbestos is inexcusable. When it comes to asbestos the right safety precautions and measures need to be in place. The reason is because asbestos is a killer and it leads to multiple deaths each year.  4000 deaths per year are caused by asbestos according to the Health and Safety Executive and therefore anyone found to be failing their employees and the public will be prosecuted, without exception.

A recent case saw 44 year old Brain Marshall taken to Brighton Magistrates Court. Mr Marshall is the managing director of Supply on Demand Ltd and he gave instructions for one of his workers to begin dismantling a building. Before any dismantling takes place it is vital that an asbestos survey is carried out to detect any of the deadly substance in the property.  In this case no survey was performed which resulted in the worker working in an environment with disturbed asbestos.

Large Fine for Breaching Health and Safety Legislation

During the inspection by the Health and Safety Executive it was discovered that Mr Marshall was fully aware of his duties regarding the asbestos survey.  He had carried out research into his duties and even went as far as requesting a quote for asbestos surveys in February 2011. However he failed to go ahead with the survey and allowed work to commence and continuing knowing he had breached his duties regarding health and safety. He was therefore fined £8,000 and was ordered to pay an additional £10, 449 in court costs.

You Must Perform Your Duties

In the recent case the director fully knew and understood his duties, he just failed to go through with them.  Before any work commences it is essential to assess whether asbestos is present. The asbestos surveys can be easily requested and they can save lives.  Any property which was built before the year 2000 may contain asbestos in the materials.  It’s vital that the survey is performed at that safe dismantling of any asbestos is performed under safe conditions by those trained to do so.

The Health and Safety Executive highlighted that Mr Marshall had blatantly ignored the law and knowingly put the lives of his workers at risk.  20 tradesmen die each week due to diseases caused directly from asbestos and there are no excuses for ignoring the laws in place to save laws.
